Abstract

This article addresses the legal and administrative implications of the application of the penalty of suspension from the exercise of the rank, graduation, position or function provided for in the Brazilian Military Penal Code applicable to the military. Starting from the finding of a possible trend in the application of this reprimand within the scope of the Military Audit of the Federal District due to recent convictions. This article analyzes the current military criminal legislation, that governs the state military police and firefighters and the Brazilian Armed Forces, comparing issues such as military seniority, counting the length of service, waring of uniform, impacts on remuneration and the possibility of attend courses. It is concluded that the penalty of suspension achieves its objective by bringing to the sentenced impacts that demonstrate a just disapproval of the conduct, affecting the military career. It is also pointed out the scarcity of studies in the field of Military Criminal Law, despite the existence of instances of Military Justice in all Brazilian states and Union and a considerable number of individuals subject to its precepts.
