CRITICAL ANALYSIS OF THE EVIDENTIAL CONTEXT IN POLICE INVESTIGATIONS:

Retrospective study at a Police Station for Homicide and Protection of the Person (DPHPP) in the State of Rio Grande do Sul- RS

Abstract

The present research approaches the urban violence problem, from the perspective of producing evidence in the intentional homicides and the indicators used in the police investigation construction.  Using it as a case study, this investigation analyzed precisely 40 (forty) expedients, corresponding to the homicide facts (consummated and tried) occurred in the year 2016, in competence of the Homicide and Personnel Protection Police Department of the São Leopoldo Municipality (RS, Brazil). At the first moment, it was observed the investigation’s probative context, through the elaboration of an indicators protocol, whose application searched determine the provided evidence considered most relevant. In this study, considering the sample analyzed, it was possible to identify a huge importance given to the indicators concerning the testimonial and documental proves, especially in relation to the reports written by the Civil Police agents (Registrars and Inspectors). In contrast, the expertise indicators, distinguished by its technical and scientific character commonly increased in the literature, did not proved essential to the indictment.
