Abstract

The present article sought to identify the real impacts caused by public custody hearings in the State of Goiás, as well as to demonstrate statistical data on the decisions taken by the magistrate in such hearings. These data were collected through a survey carried out with the 7th criminal branch of Goiânia responsible for conducting the hearings in the capital, as well as with the Public Security Observatory of the State of Goiás. It was found that approximately 55% of the arrests in flagrante first quarter of 2018 were converted into provisional release. This factor sometimes generates the demotivation of the police who deal daily with crime, in addition it is important to emphasize that there is a policy of disqualification, where due to the lack of structure in the Brazilian prison system sometimes seeks to redress the current situation of prisons. It was possible to analyze that in a short period of time there is a high rate of arrests in flagrante and to verify characteristics, profile and other aspects about the audiences. The research proves important, since it shows the peculiarities of the institute and the outcomes of the magistrates' decisions. It is important to discuss the matter, as it directly reflects on public security, specifically the Military Police of the State of Goiás, which, in addition to other institutions, acts jointly with the judiciary.
