Abstract

This article sought to analyze the procedure for applying fines to pedestrians and cyclists, established by the Resolution of CONTRAN 706/2017, regarding the lack of personal identification document of the offender at the time of the assessment. To do so, a bibliographical research was carried out on the process of development of the pedestrian figure and the cyclist in traffic, as well as on the implications of the standardization of the procedure of assessment of articles 254 and 255 of the CTB, through said Resolution. After that, a field survey was carried out by means of a questionnaire applied to the effective military police officers of the 16th BPM, of the city of Formosa. It was possible to verify that the police face difficulties in the identification of infractors who do not carry documentation of personal identification, to the detriment of the systems of consultation are restricted to certain characteristics. Parallel to this Resolution, military police believe that the measures described have significant gains for society and for transit, but they argue that the mechanism adopted for the assessment procedure will be ineffective due to the complex difficulties in applying such fines in criminal situations, because these are routine actions of citizens, being more involved in an administrative procedure. The importance of the research is evidenced by reporting one of the main obstacles that the military police can encounter at the moment of applying these penalties, besides raising awareness of the importance of the Military Police as a traffic inspector, reduction of accident rates.
